Terms of Service

1. Operator

Awesomelist is operated by pathways digital SL, C/ Gremi de Sabaters 21, 07009 Palma, España (“we”, “us”, “our”). Contact: support@awesomelist.link.

2. Acceptance

By accessing or using https://awesomelist.link (the “Service”), you agree to these Terms and ourPrivacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Nature of the Service

The Service is a free, informational index of publicly available third-party “awesome lists” and related links, primarily sourced from GitHub. We crawl, parse, score and present metadata and excerpts. We do not own the underlying lists, repositories or linked projects, and we do not operate as a publisher of their full content.

The Service is provided on an “as is” and “as available” basis. Features, scores, rankings, search results and availability may change or stop without notice.

4. No professional advice

Nothing on the Service constitutes legal, financial, security, medical or other professional advice. You rely on indexed information and outbound links at your own risk.

5. Third-party content and links

Lists, repositories, websites and resources linked from the Service are provided by third parties. We do not control, endorse (except where expressly labelled Sponsored), warrant or assume responsibility for third-party content, licences, malware, availability, privacy practices or legality. Your use of third-party sites is solely between you and those third parties.

6. Intellectual property

Our branding, site design, software, compilation of the index presentation, scoring methodology description and original text on the Service are owned by us or our licensors. Third-party names, marks and README content remain owned by their respective rights holders. You may not scrape the Service in a way that overloads our systems, republish substantial portions of our compiled index as a competing service, or remove attribution we display to original list authors, except as allowed by mandatory law or our prior written consent.

7. Acceptable use

You agree not to:

• use the Service for unlawful, fraudulent, harmful or abusive purposes;
• attempt to disrupt, probe, overload or circumvent security or rate limits;
• misrepresent affiliation with us or with list authors;
• submit knowingly false, infringing or malicious suggestions or communications;
• use automated means in a manner that impairs the Service for others without our permission.

We may suspend or block access where we reasonably believe these Terms are violated.

8. Suggestions and submissions

If you suggest lists (including via GitHub issues) or send feedback, you grant us a worldwide, non-exclusive, royalty-free licence to use that material to operate and improve the Service. You represent that you have the rights needed to submit it and that it does not violate law or third-party rights.

9. Sponsored placements and affiliates

Some placements are paid and labelled Sponsored. Some outbound links may be affiliate links and are marked as such. Sponsored or affiliate status does not change our scoring methodology for organic list ranking unless we expressly state otherwise.

10. Takedown and complaints

If you believe material should be removed or corrected, contact support@awesomelist.link. We will review good-faith requests. We may remove, delist or modify entries at our discretion, including to comply with law or platform rules.

11. Disclaimers

To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, non-infringement and quiet enjoyment. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that scores and freshness badges are correct.

12. Limitation of liability

To the maximum extent permitted by applicable law, pathways digital SL and its directors, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or business opportunities, arising out of or related to the Service or these Terms, whether based in contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of (a) fifty euros (EUR 50) or (b) the total amounts you paid us for the Service in the twelve (12) months before the claim (if any). Because the public index is free, that amount will often be EUR 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Spanish law, including liability for wilful misconduct (dolo), or mandatory consumer rights where they apply.

13. Indemnity

To the maximum extent permitted by law, you will defend, indemnify and hold harmless pathways digital SL and its directors, officers, employees, contractors and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) your submissions or communications; or (d) your violation of any law or third-party right.

14. Changes to the Service or Terms

We may modify or discontinue the Service at any time. We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms where permitted by law. If you do not agree, stop using the Service.

15. Governing law and venue

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of Spain, without regard to conflict-of-law rules that would refer to another jurisdiction.

Subject to mandatory consumer protection rules that cannot be waived, the courts of Palma de Mallorca, Spain, have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. Consumers habitually resident in the EEA may also bring proceedings in the courts of their place of residence where mandatory law so requires.

16. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Imprint, are the entire agreement between you and us regarding the Service and supersede prior understandings on that subject.

17. No waiver

Failure to enforce a provision is not a waiver of our right to enforce it later. Any waiver must be in writing to be effective.
